11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUIZ SPAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) DURING THE TWELVE MONTHS PRIOR TO THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you.

You agree to defend, indemnify, and hold harmless Quiz Span, its owner Muhammad Faisal, employees, contractors, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

  • Your violation of any third-party rights

13. Termination

13.1 By You

13.2 By Us

Any legal actions not subject to arbitration shall be brought exclusively in the courts of Lahore, Pakistan, and you consent to the jurisdiction of such courts.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Quiz Span regarding your use of our services.

16.2 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

16.3 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16.4 Assignment

16.5 No Agency

Nothing in these Terms shall be construed as creating a partnership, joint venture, agency, or employment relationship between you and Quiz Span.

16.6 Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms where such failure results from any cause beyond our reasonable control.
